What kind of reality is legal reality, how is it created, and what are its a priori foundations? These are the central questions asked by the early phenomenologists who took interest in social ontology and law. While Reinach represents the well-known “realist” approach to phenomenology of law, Felix Kaufmann and Fritz Schreier belonged to the “positivist” “Vienna School of Jurisprudence,” combining Hans Kelsen’s Pure Theory of Law with Edmund Husserl’s phenomenology—and thereby challenging Reinach’s views on how legal reality and the (...) legal a priori were to be conceived. This paper addresses the controversy between these positivist and realist approaches to phenomenology of law, with the goal of introducing the lesser known theories of Kaufmann and Schreier. The special focus on their critique of Reinach’s outline should give us an overview of their positions vis-à-vis the basic and a priori elements of which legal reality consists and the role that phenomenology plays in analyzing them. There is one general tendency to be noted: While the phenomenological legal positivists see the root of legal reality in an act of interpretation according to a “normative scheme of interpretation,” Reinach locates the roots of legal reality in social interaction and argues for the existence of entities independent of any interpretation. Edward Feser defends the ‘Aristotelian proof’ for the existence of God, which reasons that the only adequate explanation of the existence of change is in terms of an unchangeable, purely actual being. His argument, however, relies on the falsity of the Existential Inertia Thesis, according to which concrete objects tend to persist in existence without requiring an existential sustaining cause. In this article, I first characterize the dialectical context of Feser’s Aristotelian proof, paying special attention to EIT and its rival (...) thesis—the Existential Expiration Thesis. Next, I provide a more precise characterization of EIT, after which I outline two metaphysical accounts of existential inertia. I then develop new lines of reasoning in favor of EIT that appeal to the theoretical virtues of explanatory power and simplicity. Over the last decade, empirical research on compassion has burgeoned in the biomedical, clinical, translational, and foundational sciences. Increasingly sophisticated understandings and measures of compassion continue to emerge from the abundance of multi- and cross-disciplinary studies. Naturally, the diversity of research methods and theoretical frameworks employed presents a significant challenge to consensus and synthesis of this knowledge. To bring the empirical findings of separate and sometimes siloed disciplines into conversation with one another requires an examination of their disparate assumptions about (...) what compassion is and how it can be known. Here, we present an integrated theoretical review of methodologies used in the empirical study of compassion. Our goal is to highlight the distinguishing features of each of these ways of knowing compassion, as well as the strengths and limitations of applying them to specific research questions. We hope this will provide useful tools for selecting methods that are tailored to explicit objectives (methods matching), taking advantage of methodological complementarity across disciplines (methods-mixing), and incorporating the empirical study of compassion into fields in which it may be missing. The well-replicated observation that many people maintain mental health despite exposure to severe psychological or physical adversity has ignited interest in the mechanisms that protect against stress-related mental illness. Focusing on resilience rather than pathophysiology in many ways represents a paradigm shift in clinical-psychological and psychiatric research that has great potential for the development of new prevention and treatment strategies. More recently, research into resilience also arrived in the neurobiological community, posing nontrivial questions about ecological validity and translatability. Drawing on (...) concepts and findings from transdiagnostic psychiatry, emotion research, and behavioral and cognitive neuroscience, we propose a unified theoretical framework for the neuroscientific study of general resilience mechanisms. The framework is applicable to both animal and human research and supports the design and interpretation of translational studies. The theory emphasizes the causal role of stimulus appraisal (evaluation) processes in the generation of emotional responses, including responses to potential stressors. On this basis, it posits that a positive (non-negative) appraisal style is the key mechanism that protects against the detrimental effects of stress and mediates the effects of other known resilience factors. Appraisal style is shaped by three classes of cognitive processes – positive situation classification, reappraisal, and interference inhibition – that can be investigated at the neural level. Prospects for the future development of resilience research are discussed. (shrink)

Many international business training programs present a viewpoint of cultural relativism that encourages business people to adapt to the host country's culture. This paper presents an argument that cultural relativism is not always appropriate for business ethics; rather, a code of conduct must be adapted which presents guidelines for core ethical business conduct across cultures. Both moral and economic evidence is provided to support the argument for a universal code of ethics. The modal collapse objection to classical theism has received significant attention among philosophers as of late. My aim in this paper is to advance this blossoming debate. First, I briefly survey the modal collapse literature and argue that classical theists avoid modal collapse if and only if they embrace an indeterministic link between God and his effects. Second, I argue that this indeterminism poses two challenges to classical theism. The first challenge is that it collapses God’s status as an intentional (...) agent who knows and intends what he is bringing about in advance. Abstract“Freedom” is a fundamental political concept: contestations or endorsements of freedom-conceptions concern the fundamental normative orientation of sociopolitical orders. Focusing on “freedom,” this article argues that the project of bringing about emancipatory sociopolitical orders is both aided by efforts at engineering fundamental political concepts as well as required by such ameliorative ambitions. I first argue that since the absence of ideology is a constituent feature of emancipatory orders, any attempt at bringing about emancipation should leverage genealogical approaches in order to (...) debunk existing ideological freedom-concepts, which can occur only by exposing the discursive functions these have come to serve for the (re-)production of dominant power relations. I then suggest that establishing and sustaining an alternative, ideology-free conception of “freedom” is a steeper task. Ensuring widespread uptake of any ameliorated concept is contingent on effective change in the relevant social environment. Where fundamental political concepts such as “freedom” are concerned, effective intervention in the relevant social environment requires radical sociopolitical change. But if such change can be brought about and enables the widespread uptake of an “improved” freedom-concept, the concept's content comes to reflect changed social facts, thereby stabilizing the particular emancipatory sociopolitical order which has newly arisen. How to engage the public in a reflection on the most pressing ethical issues of our time? What if part of the solution lies in adopting an interdisciplinary and collaborative strategy to shed light on critical issues in bioethics? An example is Art + Bioéthique, an innovative project that brought together bioethicists, art historians and artists with the aim of expressing bioethics through arts in order to convey the “sensitive” aspect of many health ethics issues. The aim of this project (...) was threefold: 1) to identify and characterize mechanisms for the meeting of arts and bioethics; 2) to experiment with and co-construct a dialogue between arts and bioethics; and 3) to initiate a public discussion on bioethical issues through the blending of arts and bioethics. In connection with an exhibition held in March 2016 at the Espace Projet, a non-profit art space in Montréal, the project developed a platform that combined artworks, essays and cultural & scientific mediation activities related to the work of six duos of young bioethics researchers and emerging artists. Each duo worked on a variety of issues, such as the social inclusion of disabled people, the challenges of practical applications of nanomedicine and regenerative medicine, and a holistic approach to contemporary diseases. This project, which succeeded in stimulating an interdisciplinary dialogue and collaboration between bioethics and arts, is an example of an innovative approach to knowledge transfer that can move bioethics reflection into the public space. It is widely recognized that motivation is an important determinant for a successful sports career. Specific patterns of motivational constructs have recently demonstrated promising associations with future success in team sports like football and ice hockey. The present study scrutinizes whether those patterns also exist in individual sports and whether they are able to predict future performance levels. A sample of 155 young individual athletes completed questionnaires assessing achievement goal orientations, achievement motives, and self-determination at t1. The person-oriented method linking (...) of clusters after removal of a residue was used to form clusters based on these motivational constructs in order to analyze the relations between these clusters and the performance level 2.5 years later. Similar to the studies in team sports, four motivational patterns were observed at t1. The highly intrinsically achievement-oriented athletes were much more likely to compete internationally [odds ratio = 2.12], compared to the failure-fearing athletes. Although team and individual sports differ in many respects, they nevertheless are characterized by similar and thus generalizable career-promoting motivational profiles: Regardless of the type of sport, the highly intrinsically achievement-oriented athletes consistently have the best potential for success. Over the last decade, numerous interventions and techniques that aim to engender, strengthen, and expand compassion have been created, proliferating an evidence base for the benefits of compassion meditation training. However, to date, little research has been conducted to examine individual variation in the learning, beliefs, practices, and subjective experiences of compassion meditation. This mixed-method study examines changes in novice meditators’ knowledge and contemplative experiences before, during, and after taking an intensive course in CBCT®, a contemplative intervention that is increasingly (...) used for both inter- and intrapersonal flourishing. The participants in this study were Christian healthcare chaplains completing a 1-year residency in Clinical Pastoral Education who learned CBCT as part of their professional chaplaincy training curriculum. Prior to and upon completion of training, we surveyed participants to assess their beliefs about the malleability of compassion, types of engagement in compassion meditation, and perceptions of the impact of taking CBCT. We also conducted in-depth interviews with a subset of participants to gain a qualitative understanding of their subjective experiences of learning and practicing compassion meditation, a key component of CBCT. We found that participants reported increases in the extent to which they believed compassion to be malleable after studying CBCT. We also found high levels of variability of individual ways of practicing and considered the implications of this for the study of contemplative learning processes. This multi-methodological approach yielded novel insights into how compassion practice and compassion-related outcomes interrelate, insights that can inform the basic scientific understanding of the experience of learning and enacting compassion meditation as a means of strengthening compassion itself. This study’s objectives were: (1) to describe and explore the ethical dilemmas surrounding the HIV-positive person in the workplace in South Africa; and (2) to describe the Rational Interaction for Moral Sensitivity (RIMS) approach as a possible mechanism for solving these ethical dilemmas. A qualitative, exploratory and descriptive research design was used. The target populations were HIV-positive employees and occupational health nurses working for a South African company. Data collected through individual HIV-positive employee interviews and occupational health nurse workgroups were (...) analysed. The ethical dilemmas were conceptualized and described within the theoretical framework of the principles of ethics, namely, autonomy, beneficence, justice and confidentiality. The article takes in to account the influence of laws in the context of violence cases and it finishes reviewing certain notion taken from the juridical work. This is done beginning with a reading based on human sciences and psychoanalysis. Neural crest cells are remarkable in their extensive and stereotypic patterns of migration. The pathways of neural crest migration have been documented by cell marking techniques, including interspecific neural tube grafts, immunocytochemistry and Dil‐labelling. In the trunk, neural crest cells migrate dorsally under the skin or ventrally through the somites, where they move in a segmental fashion through the rostral half of each sclerotome. The segmental migration of neural crest cells appears to be prescribed by the somites, perhaps by an (...) inhibitory cue from the caudal half. Within the rostral sclerotome, neural crest cells fill the available space except for a region around the notochord, suggesting the notochord may inhibit neural crest cells in its vicinity. In the cranial region, antibody perturbation experiments suggest that multiple cell‐matrix interactions are required for proper in vivo migration of neural crest cells. Neural crest cells utilize integrin receptors to bind to a number of extracellular matrix molecules. Substrate selective inhibition of neural crest cell attachment in vitro by integrin antibodies and antisense oligonucleotides has demonstrated that they possess at least three integrins, one being an α1β1 integrin which functions in the absence of divalent cations. Thus, neural crest cells utilize complex sets of interactions which may differ at different axial levels. (shrink)

We prove that the Principle of Dependent Choices (DC) implies that the closed unit ball of a uniformly convex Banach space is weakly compact and, in particular, that the closed unit ball of a Hilbert space is weakly compact. These statements are not provable in ZF and the latter statement does not imply DC. Furthermore, DC does not imply that the closed unit ball of a reflexive space is weakly (...) compact. (shrink)

The welfare of farmed fish is often regarded with less concern than the welfare of other husbandry animals, as fish are not universally classified as sentient beings. In Norway, farmed fish and other husbandry animals are legally protected under the same laws. Additionally, the legislature has defined a number of aquaculture-specific amendments, including mandatory welfare courses for fish farmers who have a key role in securing animal welfare, also with regards to noting welfare challenges in the production process. This article (...) uses fish welfare courses as a site from which to inquire about the common-sense understanding of fish welfare in Norwegian fish farming. The focus is specifically on fish farm employees, their experiences of welfare-related issues and contradictions in their daily work, and the struggle to act responsibly in aquaculture settings. Through participant observation at welfare courses, as well as interviews and conversations with fish farm workers, the article details how challenges are experienced ‘on the ground’, and suggests how fish farm workers’ own experiential knowledge might be mobilized to improve the general welfare of farmed fish. I develop an externalist perspective and analysis of the relatedness of loneliness and (harmful) alcohol use and the concept of loneliness. I depart from twenty qualitative interviews with people undergoing inpatient treatment for alcohol dependence. Both, loneliness and its relatedness to alocohol dependence turn out to be complex relational and interactional phenomena whose occurrence and dynamics depend on the social and situational conditions under which they arise. Despite huge variations in interviewees’ experiences of loneliness, they share a common phenomenological and (...) analytical structure. Loneliness arises when instances of social interaction fail to arrive at mutual understanding within a certain social context. Loneliness is neither reducible to individual experiences nor to distinctive characteristics of a person. Rather, it presents an evaluative and interactional phenomenon, a person’s awareness of his/her failure to establish mutual understanding with others in social interaction. The relatedness of alcohol dependence and loneliness is neither conceptual nor causal nor explainable by facts about the individuals concerned, but depends on the kind of loneliness involved and the function habitual ways of drinking alcohol have in a person’s everyday life and social environment. Animal welfare in pig production is frequently a topic of debate and is sensitive in nature. This debate is partly due to differences in values, forms, convictions, interests and knowledge among the stakeholders that constitute differences among their frames of reference with respect to pigs and their welfare. Differences in frames of reference by stakeholder groups are studied widely, but not specifically with respect to animal behaviour or welfare. We explored this phenomenon using a qualitative behaviour assessment . Participating stakeholders (...) were classified into two expert groups consisting of pig farmers and animal scientists and a lay-group consisting of urban citizens . The stakeholders were asked to observe the behaviour of a specific pig in each of the nine videos and to assign a score for each video using 21 predefined terms describing the mood, such as ‘happy’ or ‘irritated’. They were asked to complete two additional questionnaires to obtain information on their frames of reference. Results from the QBA showed that the pig farmers observed the behaviour of pigs more positively than the urban citizens and the animal scientists. This was evident from the consistently higher scores on the positive terms to assess pig behaviour. The questionnaires revealed that the farmers had a different frames of reference regarding pigs and different understanding of welfare, which might explain the differences in assessment. In a follow-up stakeholder workshop, which focussed on differences in observation, QBA showed to be an effective tool to stimulate mutual learning among stakeholders, which is necessary to find shared solutions. Family research has mostly concentrated on relationships between parents and children or between women and men. On the other hand, feminist studies have explained problems within woman-to-woman relationships deriving from patriarchy. This article focuses on problematic adult woman-to-woman family relationships. More specifically, it discusses two women's ambivalent emotions narrated and experienced in their problematic female family relationships. The authors suggest that feminist studies should take into account culturally dominant narratives interlinking female subjectivity and responsibility over the private sphere. Ambivalence arises (...) in situations where individuals encounter contradictorily structured power hierarchies, i.e. simultaneously trying to follow the rules of kinship order and the desire for agency. Recent research put forward the hypothesis that eye movements are integrated in memory representations and are reactivated when later recalled. However, “looking back to nothing” during recall might be a consequence of spatial memory retrieval. Here, we aimed at distinguishing between the effect of spatial and oculomotor information on perceptual memory. Participants’ task was to judge whether a morph looked rather like the first or second previously presented face. Crucially, faces and morphs were presented in a way that the morph (...) reactivated oculomotor and/or spatial information associated with one of the previously encoded faces. Perceptual face memory was largely influenced by these manipulations. We considered a simple computational model with an excellent match that expresses these biases as a linear combination of recency, saccade, and location. Surprisingly, saccades did not play a role. The results suggest that spatial and temporal rather than oculomotor information biases perceptual face memory. (shrink)

The pursuit of unproven stem cell-based interventions is an emerging issue that raises various concerns. Physicians play different roles in this market, many of which engage their legal, ethical and professional obligations. In Canada, physicians are members of a self-regulated profession and their professional regulatory bodies are responsible for regulating the practice of medicine and protecting the public interest. They also provide policy guidance to their members and discipline members for unprofessional conduct.

This paper argues that Maimon’s metaphilosophy presents a distinctive view on what the scientific role and method of philosophy should consist in: in the production of fictions of systematicity. It shows how Maimon’s philosophy of science links to metaphilosophical views, and ultimately leads him to adopt the so-called “method of fictions” to transform philosophy into a proper science. By connecting his remarks on scientific fictions and their methodological role with Kant’s doctrine of regulative ideas and the latter’s conception of systematicity, (...) the paper develops a systematic account of the method of fictions, its employment in theoretical philosophy and the scientific image resulting from this view. Research on young children in environmental education (EE) has focused on unstructured play in, or experiencing, nature. Little attention has been paid to young children’s stewardship efforts, or to the relation of such efforts to young children’s learning and capacity to contribute to their communities and local nature. This perspectives paper draws on the first author’s experience guiding pre-k and kindergarten children (4–6 years old) in outdoor educational projects in Santo Domingo (SD), Dominican Republic, in which the children produced a (...) park guide and a short film. In addition to becoming resources for the local community, these products are an example of children’s civic contributions. In “return on investment” language, guiding young children in outdoor experiences and reflecting on the experience represent the investment and the park guide and other products, and importantly, children’s recognition of their ability to make contributions to their community, represent the return on investment. Based on our observations that young children can make significant contributions to their communities when given the opportunity, this perspectives paper argues for a research agenda and investment in opportunities for young children to contribute to their socio-ecological communities. To support our perspective, we first review and critique the prevailing and emerging paradigms of early childhood EE, following which we briefly describe the Santo Domingo (SD) project, and close by integrating past work with the first author’s experience to argue for the importance of including young children in stewardship efforts. In this paper I develop an account of Fichte’s conception of philosophical construction. Following the latter’s definition of philosophy as the ‘science of science’, philosophy is to be understood as a normative theory of what should qualify as science. In order to ground scientific knowledge-production as such, philosophy itself has to acquire a scientific method, through the application of which the constitution of scientific knowledge is secured. In systematic continuity to Kant’s account of geometrical construction, Fichte develops a philosophical method (...) that exploits the special epistemic conditions of performativity. Construction is then defined as an experimental, self-reflexive performance that exemplifies consciousness. Throughout its acts of exemplification this reflexive kind of self-observation yields a particular type of experience, which ultimately satisfies the Science of Knowledge’s demand for certainty, that is intellectual intuition. In this article, we explore the extraction of recursive nested structure in the processing of binary sequences. Our aim was to determine whether humans learn the higher-order regularities of a highly simplified input where only sequential-order information marks the hierarchical structure. To this end, we implemented a sequence generated by the Fibonacci grammar in a serial reaction time task. This deterministic grammar generates aperiodic but self-similar sequences. The combination of these two properties allowed us to evaluate hierarchical learning while controlling (...) for the use of low-level strategies like detecting recurring patterns. The deterministic aspect of the grammar allowed us to predict precisely which points in the sequence should be subject to anticipation. Results showed that participants’ pattern of anticipation could not be accounted for by “flat” statistical learning processes and was consistent with them anticipating upcoming points based on hierarchical assumptions. We also found that participants were sensitive to the structure constituency, suggesting that they organized the signal into embedded constituents. We hypothesized that the participants built this structure by merging recursively deterministic transitions. (shrink)
